I totaled my new truck Monday. I'm sore as hell. The repair estimate is $26k. I was driving the lady in front of me hit the car in front of her then I hit her. She never hit her brakes. Well the cops said she was at fault. But she is saying I pushed her into the other car and she is hurt bad and that she is sueing. Now I am buying dash cams for my truck.

It took me to long to process that the car in front of me stopped moving forward.

so what will happen is that the cops or judge will ask the car in the very front if they noticed one or two collisions to their vehicle. if you hit the middle car that hard, that fucker is hitting the 1st car again for sure. I was the 2nd car in a 4 car. the first car came to a complete stop on the highway from 65mph to look at a fire truck, I barely tapped them, then the car behind me totaled my car, then theirs got totaled. they ask how many times you felt being struck.

I hate to say this.. in my state rear ending is no matter what the person at the back's fault..... the argument is that you followed to close ..either way .what matters is your health and that you walked away.. that is why you got insurance to take care of the things that can be fixed... and humans can not be restarted once then break

So I wish you well, all though it sounds like you will be sore for a couple of days

Yea here it's a little different. I had to buy another truck today and we haven't settled my other truck yet. I got a bigger truck and added $500,000 in coverage.

Wow, I thought it was a common law when one hit you from behind they were at fault.

Glad you are ok and have new wheels again.

Why are you looking for an attorney? Your auto insurer has to defend (provide you with an attorney ) and indemnify you under these circumstances. I assume you already put them on notice of the incident? Do not provide any statements other than to your insurer or its representative.

The only reason I could imagine you needing an attorney is if you were intending to pursue your own personal injury suit.

I was told by several people to get one but now it seems these people are just trying to get me to try and get money out of this.

You don't need one to defend you if you get sued. The insurance company will provide you with a lawyer for that. The only reason you might need your own lawyer in this regard is if you have insufficient insurance coverage, which doesn't seem to be the case.

However, if you want to pursue your own suit for personal injury you will need to get a separate attorney who will take the case on a contingency fee basis.

I live in Cali. Although not 100% sure I thought it was always the rear Enders fault. If you're not tailgating you have time to still is what I've always been told.

Rear ending is generally the fault of the person behind, unless it is obvious the one in front did something wrong. In this case sounds like lady in middle car is at fault as she was cited. My son was in a motorcycle acc7dent, got paid from it, sliced up his leg and can no longer be a motorcycle mechanic because he is terrified to ride again. As sole was drunk, ran from cops and had a previous due, was in company truck with a 6 million dollar policy. Dude got sent to prison for 5 years for aggravated due and vehicular assault. My son could only get around 280K. After lawyer fees and paying off his bills from hospital (what ins wouldn't cover) and his other bills he ended up with about 50K in his pocket. So I think your safe. If she does sue, take it to trial with a jury, they will smell the bs and not award her any money.
